TERMS AND CONDITIONS
By entering a NearPay’s Giveaway (a “NearPay’s Sweepstake” or “Sweepstake”), you will be bound by these Terms and Conditions and you acknowledge that you satisfy all eligibility requirements.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
Promotion Description. NearPay’s Sweepstake begins on 8th September 2022 at 00:00 A.M. and ends on 16th September 2022 at 12:00 P.M.
Eligibility. Open to legal residents of all countries who are eighteen (18) years or older (the "Entrant"). Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the "Promotion Entities"), are not eligible to enter the Sweepstakes or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. "Household Members" shall mean those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
Prize(s).
Grand Prize: multiple NFTs of the discretion of the Sponsor will be awarded to multiple winners of the Sweepstake.
Only one prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winners. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these terms is unavailable or cannot be awarded, in whole or in part, for any reason. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items.
This Sweepstakes is open to all countries. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with these terms will result in forfeiture of the prize.
Prize(s) will be fulfilled and delivered by NearPay or one of its affiliates using your NEAR address you provided to NearPay. Each winner will be responsible for paying any taxes and any other expenses incurred, including any income taxes, sales or use taxes, value added taxes, goods and services taxes.
Each prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you win a prize, you may not transfer, assign, or redeem the prize for cash. NearPay may substitute a prize with a prize of equal or greater value.
How to Enter. You may enter the Sweepstake via the entry method described below.
By completing specified requirements, you will be eligible to receive a prize.
NearPay is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or your failure to adequately monitor any email account.
Other Sweepstakes. By entering a Sweepstake, you will not be eligible to receive any prizes awarded in any other Sweepstakes unless you enter each Sweepstakes separately.
Additional Terms. NearPay reserves the right to modify or cancel a Sweepstake at any time. NearPay and its affiliates are not responsible for: (a) lost, misdirected, late, or incomplete entries or for inaccurate entry information; (b) any operation or transmission error, theft, unauthorized access to, or alteration of, entries; or (c) damage to any computer or device resulting from downloading Sweepstake materials. NearPay may disqualify any individual found to be: (x) tampering with a Sweepstake; (y) violating these Terms and Conditions; or (z) acting in an unsportsmanlike or disruptive manner or with intent to threaten or harass any person. Incomplete and robotic, automatic, programmed or similar entries will be disqualified. The authorized subscriber of the account used to enter a Sweepstake at the actual time of entry will be deemed to be the participant and must comply with these Terms and Conditions in the event of a dispute as to entries submitted by multiple users having the same e-mail account.
Miscellaneous. Sweepstake is governed by the laws of the United States. By entering a Sweepstake, you agree (for yourself and your heirs) that NearPay and each of their respective affiliates and agents, and any entity involved in any aspect of the Sweepstake (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Sweepstake, even if caused or contributed to by the negligence of any of the Released Parties.
You agree that NearPay’s decisions related to Sweepstake and all distribution of prizes are final. Each winner agrees that, by participating in a Sweepstake, NearPay and their respective affiliates may use the winner’s name in any manner and in any medium for its promotional purposes without additional compensation, including posting in a winner’s list, except where prohibited by law, and NearPay and their respective affiliates may be required to disclose the winner’s address to state regulatory authorities.
Limitation of Liability. NearPay assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstake; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstake; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstake or download of any materials in the Sweepstake.
If, for any reason, the Sweepstake is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstake, NearPay reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstake in whole or in part. NearPay and Released Parties shall not have any further liability to any participant in connection with the Sweepstakes.
Privacy. Any personal information supplied by you will be subject to the privacy policy of NearPay posted at Legal | Privacy Policy (nearpay.co). By entering the Sweepstake, you grant NearPay permission to share your email address and any other personally identifiable information with the other Sweepstake entities for the purpose of administration and prize fulfillment.

How to Enter. You may enter the Sweepstake via the entry method described below.
- Sign up (register) with NearPay following the link: nearpay.co/nearcon22.
- Confirm your email address through the letter received from NearPay to your email address specified by you during the registration procedure.

- In order to receive a prize, you will have to provide your NEAR address to NearPay by filling the address into the NearPay system following the notification received through your account with NearPay.
